Google Confusing Us! What Penguin Update!

Can you have a look into this please? I did a search for auto accident Las Vegas in chrome and I am seeing this same chiropractor coming up with 2 different URLs that have the same content. Why do you think these sites are not being pushed off from the first page if it has duplicate content? I am just curious about this interesting find!

Both websites are hosted on different servers and phone number is mentioned as an image.
I think Google is not catching this till now, but we are excited to see the results in a couple of days.

WHY GOOGLE ALGORITHM IS NOT FINDING THIS? DOES GOOGLE NEED TO RE-WORK ON THIS PENGUIN UPDATE?
